Online-Casinos in Texas

No legal online casinos. Casino gaming would require a constitutional amendment approved at a statewide referendum. HJR 137 (up to 10 resort casino licences) and HJR 134 (statewide sports betting) were filed in the 2025 session and did not pass. SB 3070, signed 20 June 2025, abolished the Texas Lottery Commission effective 1 September 2025 and moved the lottery and charitable bingo to TDLR.

No retail or online sports betting. The 2025 session adjourned without advancing a sports betting or casino constitutional amendment, and in April 2026 Gov. Greg Abbott said casino gambling remains constitutionally impermissible without a statewide referendum he does not plan to champion. The legislature meets only in odd-numbered years, so 2027 is the next regular opportunity. (The project brief records Texas as having 'failed again in 2026'; this reflects the 2026 political closure rather than a regular 2026 session, which Texas does not hold.)

No Texas sweepstakes-casino ban is in place. SB 517 (2025) would have redefined gambling device definitions to reach dual-currency models but failed in the Senate before the session ended. Texas remains one of the largest open markets for sweepstakes casinos; separate long-running enforcement against physical '8-liner' game rooms does not target online dual-currency platforms.

Texas issues no online casino or sportsbook licences, so offshore and crypto casinos serving Texans are unlicensed and operate against Texas Penal Code ch. 47 gambling provisions. Enforcement has historically focused on physical game rooms rather than offshore sites.
